These Terms of Service apply to store.drbatniji.com (the "Store"), operated by Batniji Facial Plastic Surgery ("we," "us" or "our"), 361 Hospital Road, Suite 329, Newport Beach, CA 92663. By using the Store or placing an order, you agree to these terms. If you do not agree, please do not use the Store.
1. Our products and the information in the Store. The Store offers skincare and related products selected by Dr. Rami K. Batniji for everyday skin care and aftercare. Product descriptions and articles in the Store are general information only. They are not medical advice, a diagnosis or a treatment plan, and buying a product does not create a physician patient relationship with Dr. Batniji or any of our providers. If you are recovering from a procedure, are pregnant or nursing, have a skin condition or take prescription medication, check with your provider before starting a new product. Follow the directions on each product, and stop using it and contact your provider if irritation occurs.
2. Who can buy. You must be at least 18 years old to place an order. Products are sold for personal use and not for resale.
3. Orders and prices. Prices are shown in US dollars and may change without notice. Placing an order is an offer to buy; your order is accepted when it ships. We may limit quantities, and we may decline or cancel an order, including for a pricing or description error, a product that is out of stock or suspected fraud. If we cancel an order after you have paid, we refund the full amount to your original payment method.
4. Payment. Payments are processed through Shopify's secure checkout. We do not see or store your full card number. Sales tax is added at checkout where it applies.
5. Shipping, returns and subscriptions. Shipping times and rates are set out in our Shipping Policy. Returns and exchanges are set out in our Return and Refund Policy. Subscribe and save orders are set out in our Subscription and Cancellation Policy. Each of those policies is part of these terms.
6. Your account. If you create an account, keep your login details private. You are responsible for orders placed through your account.
7. Store content. The text, photographs and other content in the Store belong to us or to the brands we carry, and are provided for your personal use. Please do not copy or reuse them for commercial purposes without our written permission.
8. Links to other sites. The Store may link to sites we do not control, such as product brands or social media. We are not responsible for their content or their privacy practices.
9. Product warranties. Products are provided as described by their manufacturers. To the fullest extent the law allows, we make no other warranties, express or implied. Nothing in these terms limits a right you have under California consumer law.
10. Limit on our liability. To the fullest extent the law allows, we are not liable for indirect or consequential damages arising from your use of the Store or its products, and our total liability for any claim relating to an order is limited to the amount you paid for that order.
11. Governing law. These terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Orange County, California.
12. Changes to these terms. We may update these terms from time to time. The date at the top shows the latest version, and the version in place when you place an order applies to that order.
